1. Acceptance of Terms
 
By accessing or using the RISE SMS platform, website, or related services (the “Service”), you agree to be bound by these Terms of Service (“Agreement”).

2. Description of Service
 
RISE SMS provides software tools designed to support the administration and management of Safety Management Systems (SMS) for aviation and related industries.
 
The Service is intended as a support tool only and does not replace operational, regulatory, or safety oversight responsibilities.
 

3. License Grant
 

RISE SMS grants you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for your internal business purposes, subject to this Agreement.
 

You may not:
 

• Resell or sublicense the Service

• Reverse engineer or attempt to extract source code

• Copy, modify, or create derivative works

• Use the Service for unlawful or unauthorized purposes
   

4. Account Responsibility
 

You are responsible for:
 

• Maintaining the confidentiality of your login credentials

• All activities conducted under your account

• Ensuring authorized use by your personnel

• You must notify RISE SMS immediately of any unauthorized access.
   

5. Customer Data and Ownership
 

You retain all rights to data submitted to the platform (“Customer Data”), including:
 

• Hazard reports

• Incident reports

• Risk assessments

• Operational safety data
   

RISE SMS:
 

• Does not claim ownership of Customer Data

• Processes Customer Data solely to provide the Service
   

You are solely responsible for:
 

• Accuracy

• Completeness

• Regulatory compliance of your data
   

6. Use of the Software
 

RISE SMS does not:
 

• Create or maintain your operational policies

• Monitor compliance with regulatory requirements

• Ensure your SMS meets FAA, ICAO, or other standards
   

You are solely responsible for:
 

• Implementation of your SMS

• Compliance with applicable regulations

• Maintenance of all safety procedures
   

7. Form Templates Disclaimer
 

Any templates provided are:
 

• General starting points only

• Not tailored to your operation
   

You are responsible for ensuring:
 

• Compliance with regulations

• Accuracy and completeness
   

8. Custom Manual Services
 

Custom SMS manuals provided by RISE SMS:
 

• Are based solely on customer-provided information

• Are drafting and formatting services only

• Do not constitute legal, regulatory, or compliance certification
   

You are solely responsible for:
 

• Reviewing and approving the manual

• Ensuring regulatory compliance

• Securing FAA or other authority acceptance
   

9. Fees, Billing, and Subscriptions
 

• The Service is provided on a subscription basis

• Fees are billed in advance unless otherwise agreed

• Subscriptions automatically renew unless canceled prior to renewal
   

RISE SMS may:
 

• Modify pricing with prior notice

• Offer promotional or trial terms at its discretion
   

Refunds are subject to applicable agreements, including any stated money-back guarantees.
 

10. Acceptable Use
 

You agree not to:
 

• Use the Service in violation of any law or regulation

• Attempt to gain unauthorized access

• Interfere with system integrity or performance

• Upload malicious code or harmful content
   

11. Service Availability
 

The Service is provided on an “as available” basis.
 

RISE SMS does not guarantee:
 

• Uninterrupted access

• Error-free operation
   

We may:
 

• Perform maintenance

• Modify or discontinue features
   

12. Data Security
 

RISE SMS implements reasonable security measures but does not guarantee absolute security.
 

You are responsible for:
 

• Proper use of the platform

• Managing access within your organization
   

13. Disclaimer of Warranties
 

The Service is provided “as is” and “as available.”
 

RISE SMS disclaims all warranties, including:
 

• Merchantability

• Fitness for a particular purpose

• Non-infringement
   

14. Limitation of Liability
 

To the maximum extent permitted by law:
 

RISE SMS shall not be liable for:
 

• Indirect, incidental, or consequential damages

• Loss of data, revenue, or business opportunities
   

Total liability shall not exceed:

The amount paid by you in the 12 months preceding the claim
 

15. Indemnification
 

You agree to indemnify and hold harmless RISE SMS from claims arising from:
 

• Your use of the Service

• Your Customer Data

• Your violation of laws or this Agreement
   

16. Termination
 

RISE SMS may suspend or terminate access if:
 

• You violate this Agreement

• Required by law
   

Upon termination:
 

• Your access will be revoked

• Data retention/export will follow applicable policies
   

17. Force Majeure
 

RISE SMS is not liable for delays or failures caused by events beyond its control, including:
 

• Natural disasters

• Internet outages

• Government actions
   

18. Changes to Terms
 

We may update these Terms at any time.
 

Continued use of the Service after updates constitutes acceptance.
 

19. Governing Law
 

This Agreement is governed by the laws of the State of Arizona.
 

All disputes shall be resolved in Arizona courts.
 

20. Entire Agreement
 

This Agreement constitutes the entire agreement between you and RISE SMS.
